LINCOLN MANOR GUARDIAN HOME CONTRACT

 

 

The purpose of this agreement is to define the conditions of the guardianship agreement between_________________________________________, hereafter referred to a “Guardian”, and Lincoln Manor Labradoodles, hereafter referred to as “Breeder”.

 

This agreement pertains to ­­­­­­­­­­­­­­­­­­­­­­_______________, an intact female Australian Labradoodle, born on _________________, micro chip ___________________, hereafter referred to as “Dog” and is entered into on ____________________.  This agreement is between Guardian and Breeder.

 

Ownership and all rights and interest to the dog shall remain with Breeder until such time as Breeder shall, by bill of sale or other written evidence of transfer, assign and transfer ownership of the dog to Guardian.  Likewise, any puppies born to Dog shall be the sole and separate property of Breeder and Guardian shall have no ownership or interest of possession rights to any such puppies.

 

Breeder is responsible for the costs of all genetic testing that Breeder chooses to do to insure that Dog is genetically sound to breed from.  The Guardian is responsible for transporting Dog to and from the Veterinarian for the testing.

 

Should Breeder decide for any reason that Dog is not genetically superior to breed from , Dog will then be desexed at Guardian’s expense.  After Dog has been desexed Guardian may keep Dog and the contract shall be considered completed and fulfilled.

 

During the term of this contract, Guardian may permanently return Dog to Breeder for any reason, at which time this contract shall terminate.

 

Guardian must bring Dog to Breeder, airport, veterinarian, or other local location as needed for breeding.  It is Guardian’s responsibility to provide transportation.  It is important that attention is given to when Dog’s cycle has started and this information given to Breeder.

 

Breeder requires 3 litters from Dog to fulfill this contract.  It Breeder chooses to desex Dog before Breeder obtains 3 litters it is ONLY the Breeders right to do so.  If Guardian desexes Dog without fulfillment of the contract Breeder has the right to full payment of Dog’s breeding price of $10,000.00.   Should Guardian deny Breeder access to Dog for mating and/or the birth of the required 3 litters Breeder has the right to request Dog be returned to Breeder immediately or Guardian agrees to provide Breeder with the breeding price of Dog of $10,000.00. 

 

Breeder will make all attempts to have the 3 litters completed within 6 seasons/heat cycles but can not guarantee that Dog will conceive on each attempt. 

 

Breeder will mate Dog on the first season/heat cycle after Dog is 12 months of age.  As long as Dog is deemed healthy and ready for the next litter Breeder will attempt 3 consecutive litters.

Breeder cannot guarantee that dog will conceive a litter at a given time and thus sets a time limit.  If the required 3 litters have not been accomplished by ______________,  Breeder will relinquish their rights to the remaining litters due them and transfer ownership of desexed Dog to the Guardian.

 

All routine feeding, upkeep, care, worming and veterinary expenses are the responsibility of the Guardian.  Guardian has the right to take Dog to a veterinarian of their choosing.  Any veterinary expenses related to the breeding and pregnancy of Dog are the responsibility of Breeder.

 

Breeder asks that Guardian keep Breeder up to date with pictures, the development of Dog and/or any concerns Guardian may have.   Breeder needs to be able to determine the exact type of coat Dog has and will need pictures.  Breeder asks Guardian to make every attempt to have Dog attend at least three or four of Breeder’s Doodle Romps a year.

 

Guardian agrees to have Dog complete at least two levels of training before Dog is one year old.

 

Guardian agrees and understands that if guardian must relocate that Dog is not to be relocated further than 2 ˝ hours drive from Breeder.  If Guardian does relocate further than 2 ˝ hours drive Guardian is to return Dog to Breeder.  If Breeder so chooses special consideration and arrangements may be made on a case by case bases for Guardian to continue as the Guardian Home.

The guardians are responsible for seeking prompt and appropriate veterinary care in the event of injury or illness of Dog.

If choices need to be made regarding type of treatment these choices must be presented to and made by Breeder unless emergency treatment is required.

 

If Dog dies accidentally due to circumstances beyond the control of Guardian, the Guardian does not owe any payment to Breeders.

 

If Dog dies due to negligence on the part of Guardian, the Guardian owes Breeder $10,000.00

 

Guardian shall pay Breeder $10,000.00 if Guardian intentionally causes injury to Dog that prevents dog from breeding or intentionally causes the death of Dog.

 

Guardian shall pay Breeder $10,000.00 if Guardian absconds with Dog, fails to advise Breeder of any change in Guardian’s address, or ceases communication with Breeder.

 

If Dog dies during whelping Breeder will provide, free of charge, a desexed replacement puppy to Guardians and the Guardianship relationship is terminated.

 

No failure to enforce a breach of this contract shall constitute a waiver of any other or subsequent breach.

 

Guardian agrees to indemnify and hold harmless the Breeder from and against all claims, liabilities, losses, costs, damages and expenses by reason of any damage to property or injury or death to individuals allegedly caused by Dog while in the possession of Guardian.

 

 

 

Guardian will notify Breeder of scheduled vacations or other absences from the area which may occur during Dog’s heat cycle or whelping time.

 

Neither Guardian nor Breeder has the right to sell Dog on to another party or require Dog back from the Guardian if Guardian has and is meeting all requirements listed in this contract

 

Should Guardian choose to break any of the above portions of this agreement, the Breeder has the right to request that Dog be returned to Breeder immediately or Guardian may pay the breeding price of Dog of $10,000.00.
